This article argues, against contemporary experimentalist criticism, that conceptual analysis has epistemic value, with a structure that encourages the development of interesting hypotheses which are of the right form to be valuable in diverse areas of philosophy. The article shows, by analysis of the Gettier programme, that conceptual analysis shares the proofs and refutations form Lakatos identified in mathematics. Upon discovery of a counterexample, this structure aids the search for a replacement hypothesis. The search is guided by heuristics. The heuristics (...) of conceptual analysis are similar to those in other interesting areas of scholarship, and so hypotheses generated by it are of the right form to be applicable to diverse areas. The article shows that the explanationist criterion in epistemology was developed and applied in this way. The epistemic value of conceptual analysis is oblique because it contributes not towards the main purpose of conceptual analysis but towards the reliable development of epistemically valuable hypotheses in philosophy and scholarship. Harper This special issue provides a good opportunity to reflect on the range of views about delusions,1 and it is good to see all the authors taking the issue of how to approach this topic seriously. Here I wish to argue that the traditional psychiatric (...) view of delusions is problematic. In the first half of this article I will group my comments on the issues raised by the papers by Klee and Bayne and Pacherie together as I think that, for their differences, they share modernist philosophical assumptions. I will argue that the modernist paradigm runs into considerable problems in considering beliefs felt by some to be unusual and I will go on to argue that we need to move beyond this paradigm and embrace different approaches, of which the work by Georgaca is an exemplar. The Trouble with (traditional Views of) Delusions The traditional psychiatric view of delusion has come under increasing attack over recent years. As Georgaca has noted, a number of problems with the assumptions in definitions of delusion can be identified when they are viewed from a social constructionist perspective (Georgaca 2000, 2004; Harper 1992, 1996; Heise 1988). For convenience I will group these under four main headings. They Are Based on a Naively Realist View of the World The criterion of inaccuracy or falsity implies that deciding on the veracity of a belief is a relatively unproblematic matter. However, the reality of claims does not always seem so important in judgments about whether a belief is delusional or not. For example, there is little evidence that mental health professionals systematically investigate the basis for people's beliefs; rather, they decide whether a belief is plausible. Thus Maher has argued that the assessment of the plausibility of beliefs is "typically made by a clinician on the basis of "common sense," and not on the basis of a systematic evaluation of empirical data" (1992, 261). He notes that it is not "customary to present counterevidence to the patient; it is not even common to present vigorous counterargument" (1992, 261) and there appears to be some empirical evidence of this (McCabe et al. 2002). Here then, we begin to see [End Page 55] how psychiatry, while claiming to have the power to judge the truth of beliefs on the basis of its status as an empirical scientific discipline, can be seen to make judgments on the basis of common sense and taken-for-granted social and cultural assumptions.Some commentators have suggested that delusions should be identified less by whether they seem to accord with reality but more by whether a person gives evidence for their belief (Gillett 1995; Spitzer 1990). However, this seems to be based on an idealized view of how people manage their beliefs in everyday life. For example, I would question how many of us have evidence for many of the beliefs (e.g., political, ethical, religious, etc.) we hold dear; indeed it would be hard to think of what evidence we could have for some of them (e.g., religious and ethical beliefs). Some recent work has suggested that the diagnosis of delusion is made on the basis of how people with delusions talk and interact; for example, some have argued that they do not appear to appreciate the hearer's point of view (Palmer 2000). However, here and in previous work, Georgaca (2000, 2004) has shown that people with delusions are able to talk about and negotiate disagreements about their beliefs and that many disputes of fact cannot be settled in conversation. People Said to Have Delusions Are Seen to Vary in the Conviction With Which Those Beliefs Are Held There is evidence that people considered to be deluded vary in the conviction with which they hold beliefs (Garety 1985) and can also be persuaded to modify their beliefs if this is conducted in a sensitive and collaborative manner (e.g., Chadwick, Birchwood, and Trower 1996). It is informed by a richer ideal of empirical success that requires not just accurate prediction but also accurate measurement of parameters by the predicted phenomena. In 1960, E. P. Wigner, a joint winner of the 1963 Nobel Prize for Physics, published a paper titled On the Unreasonable Effectiveness of Mathematics in the Natural Sciences [61]. This paper can be construed as an examination and affirmation of Galileo's tenet that “The book of nature is written in the language of mathematics”. To this effect, Wigner presented a large number of examples that demonstrate the effectiveness of mathematics in accurately describing physical phenomena. Wigner viewed these examples as (...) illustrations of what he called the empirical law of epistemology, which asserts that the mathematical formulation of the laws of nature is both appropriate and accurate, and that mathematics is actually the correct language for formulating the laws of nature. At the same time, Wigner pointed out that the reasons for the success of mathematics in the natural sciences are not completely understood; in fact, he went as far as asserting that “… the enormous usefulness of mathematics in the natural sciences is something bordering on the mysterious and there is no rational explanation for it.”. The Encyclical also, however, associates this perspective wjth that of the commandments when it cites the response of Jesus, who, after having invited the rich man to turn his gaze toward the One who alone is good, directs the young man to observe the Decalogue. This is not simply a juxtaposition of different and mutually incompatible perspectives. While it is not obliged to provide a theoretical and systematic justification, the papal document does solicit attempts to grasp the constitutive connections that would provide for an integration of these two categories; this is specifically the task of the moral theologian. Thus, when the Encyclical suggests that the question about happiness-as the question "about the full meaning of life," and as prior to the question "about rules to be followed"-is the "echo of a call from God who is the origin and end of man's life" (n. 7), it situates itself within the perspective of the renewal to which the Second Vatican Council called moral theology, which, in its theoretical exposition, will have the task of illustrating "the lofty vocation which the faithful have received in Christ, the only response fully capable of satisfying the desire of the human heart" (n. 7).4 This article intends to accept the invitation of the Encyclical and the Council by thematizing the relation between the desire for happiness and the commandments. This volume of Teilhardiana contains twenty-one essays and notes written between 1921 and 1955, some of which Teilhard published in journals and some of which were not published until after his death in 1955. Though the essays are on different topics, the constantly recurring theme is Teilhard's defense of evolution, or, more specifically, transformism, as a necessary framework principle for biological science, and in particular for that offshoot science of biology which Teilhard regards as the natural history of the origin (...) and development of thought, or the science of the phenomenon of man. Teilhard is willing to extend his genetic and teleologically informed method below the level of the life sciences to geology and eventually to the whole material-cum-radial-energy universe. At the same time as he is trying to overcome the objections of his fellow scientists to transformism on the basis of the paleontological record, Teilhard is constantly arguing the non-opposition between his evolutionism and the Christian doctrine of Creation. These are all familiar Chardinian themes, but what one gets in this volume that is lacking to a large extent even in The Phenomenon of Man is a more detailed account of Teilhard's philosophy of science. The critics have demanded this of Teilhard, and though it takes some piecing together, one can, on the basis of The Vision of the Past, sketch a portrait of Teilhard the critic of positivism and, particularly, instrumentalism. This volume is a collection of papers from the Third Consultation on Hermeneutics at Drew University. The goal of this conference was, in Hopper's words, to "question what kind of language, or thinking, is appropriate to a fundamental ontology, to a language that does not commit objectification, or reification, upon its subject matter in the very mode of its utterance." The first essay in the volume was not read at the conference, but is reprinted from a 1961 Harper's magazine, (...) namely, Norman O. Brown's "Apocalypse: the Place of Mystery in the Life of the Mind." It is unfortunate that Brown is given the place of honor in this collection, since his essay is somewhat offensive and irresponsible. Consider, for example: "Truth is what any fool can see. This is what is meant by so-called scientific method. So-called science is that attempt to democratize knowledge—the attempt to substitute method for insight, mediocrity for genius, by getting a standard operating procedure," or "Vacancy is not the worst condition of mind." Of the remaining papers in this book, the high-points are Kenneth Burke's "Theory of Terminology," a reader's key to his many fine writings on figurative language, Beda Allemann's "Metaphor and Antimetaphor," an interesting analysis of Kafka's prose style, and Owen Barfield's "Imagination and Inspiration," an essay on the difficulties of talking about spiritual experiences in understandable language. In fact, Barfield levels the most relevant criticism at this symposium when he cautions that "very different considerations apply to the exercise of the imagination on the one hand, and, on the other, any attempt to investigate its nature."—E. Indeed, it is Aquinas's gradual integration of satisfaction as a motive for the Incarnation subordinate to love (166) that enables Aquinas aptly to locate satisfaction within the Christian life (cp. 47, 136, 142, 166) and accounts for Cessario's subtitle. Third, I am not clear on Ccssario's (or my own!) (...) stand on how we ought sort out the respects in which Thomas's and our perspectives merge (cp. xiv). In his conclusion Cessario is cautious, suggesting that "if the term ' satisfaction ' cannot be restored to current usage, then certainly the substance of Saint Thomas's understanding of satisfaction can and should be." (256). But, given Cessario's own persuasive display of the way satisfactio pervades the very texture of Aquinas's theology, I am not sure we can have the "substance" without the term-or vice-versa. Clearly Cessario thinks the merging is substantive. But he himself teaches us that supporting this claim involves supporting claims for exegetical, liturgical ecclesial, and other practices. Those of us who think that satisfactio is a description rather than "the guiding model or key notion" (xx, my emphasis) for thinking Christ crucified will need to see such support worked out in relation to the competing sotcriologies Cessario mentions (267) as well as ecumenical discussions of justification which were understandably outside the scope of this book (151). But a single book can only accomplish a single thing-and this book clearly succeeds in showing us how Thomas can be brought to bear on contemporary theological issues. How We Know is a collection of six papers delivered in 1984 at the twentieth Nobel Conference, held at Gustavus Adolphus College in St. Peter, Minnesota. Two words that came to my mind as I worked through the papers were "fascinating" and "frightening". The Conference dealt with cognitive science and a number of the authors have come up with interesting, provocative, and often orig'inal observations about how the human mind operates when it hies to remember and to understand. In his Introduction Michael Shafto, who is a Scientific Officer in the Personnel and Training Research Programs of the United States Office of Naval Research, notes that cognitive science as the work of a coalition of thinkers is barely a decade old, and he reminds the reader that the methods BOOK REVIEWS 59.7 of cognitive science are those of experimental psychology, physiology, and computer science. Though the Confermce was supposedly aimed at nonspecialists, the reader unfamiliar with cognitive science might find some of the papers a bit difficult. Certainly the backgrounds of the authors are very impressive. The first four papers in the collection are by Gerald Edelman, Brenda Milner, Roger C. Schank, and Herbert A. Simon respectively. Edelman is the Director and Scientific Chairman of the Neurosciences Research Program at Rockefeller University; Milner is Professor of Psychology in the Department of Neurology at McGill University: Schank is Professor and Chairman of the Computer Science Department at Yale; and Simon is Professor of Computer Science and Psychology at Carnegie-Mellon University. Calling his theory of the hum:m brain "Neural Darwinism," Edelman claims that the brain is Darwinian. Taking Darwin's theory of natural selections and applying it to the brain, Edelman argues that during ontogeny and behavior those groups of neurons are chosen that are adaptive for the organism. Milner explores the neurophysiological basis of that special moment when a new experience affects the brain. Insisting that memory is not merely a passive reproi!ucer but rather actively selective, Milner, relying on her studies of patients. with loss of memory, suggests that the frontal lobes of the brain hnve a special role in memory. Late in his career, Immanuel Kant would turn his attention to this perennial question with an elaborate account of " radical evil " in Religion within the Limits of Reason Alone. His discussion produced consternation among his admirers, such as Goethe, and continues to produce puzzlement among his commentators. Among the chief difficulties facing the modern-day interpreter has been (...) the welter of complex terminology tossed up by Kant's attempts to tame his topic. The Kant specialist can justifiably suppose that if only he or she could un-scramble the terminology, grasp the intended interconnections among the terms, and set the discussion within the context of the entire critical philosophy, the result would be a reasonably clear view of Kant's theory of the nature and source of moral evil. There is of course some justification to this vaguely masochistic approach to the matter, yet such an approach, I fear, leads inevitably to frustration. This is because, despite all the appearances to the contrary, Kant never really explains moral evil in the discussion of radical evil in Religion. To be sure, he offers a definition of what moral evil is, by the terms of his philosophy. Nevertheless, he never really accounts for evil, nor does he offer anything remotely approaching an answer to my opening question. The deepest part of Kant's analysis is not a response to that question, but a link between moral evil and human freedom, and this link is utterly inexplicable, for the same reason that freedom itself is, for Kant, ultimately inexplicable. Thus, by this reading of the theory of radical evil, we are not finally led to comprehend Kant's view of evil. Instead, we are 246 THE INSCRUTABILITY OF MORAL EVIL IN KANT 247 reminded of the contingent nature of the exercise of freedom, the unfathomable quality of the process of character-building, and, finally, the sheer inscrutability of moral evil itself. Kant is theorizing about human nature in a way that gradually discloses the futility of domesticating this topic conceptually or rationally. This point is worth stressing, partly because of certain stereotypes that persist regarding the things Kant's philosophy supposedly renders in rational form. And, obviously, the point can be stressed in the present context by pursuing further the notion that moral evil is, for Kant, inscrutable. The inscrutability of moral evil does not pop into view all at once, for Kant's discussion in Religion is set in the context of a complex account of the structure of the will, the nature of the incentives capable of determining the will, and the issue of freedom. Consequently, in what follows I shall attempt to trace the Kantian line of thought lying behind his agnosticism regarding the source of moral evil. -IFor Kant, moral evil resides in a maxim.1 A maxim is for him a special kind of principle, one which guides or informs actionin effect, a "practical principle." The very idea of a maxim is a key element in Kant's efforts to determine how reason can be practical. Harper appeals to philosophy, literature, psychiatry and theology from Augustine to R. D. Laing to present what he calls a coherent picture of the major existential themes found in interior experience. This is not a book in existential philosophy in the usual sense. Indeed Harper argues that academic philosophers have failed to adequately treat interior experience. Interior experience, he says, is largely emotional and does not yield easily to analysis and conceptualization. Harper’s style is exploratory and suggestive, (...) even lyrical at points, as he interprets human experience in accordance with the themes: existence, insecurity, the void, self-isolation and presence. Human existence is, according to Harper, what I make it to be. Yet it is also characterized by insecurity or anxiousness, a sense of estrangement rather than fulfillment and reconciliation. The experience of contemporary man is characterized not only by insecurity but also by a sense of emotional and spiritual disability. God is absent and man experiences reality as indifferent and himself as alone and isolated in a void. Man is not, however, without hope for there is in existentialism and in personal experience the parallel theme of presence, being open to reality as grace, which gives hope of acceptance and love, satisfying the whole man. Harper’s study is scattered with references to Augustine, Kierkegaard, Heidegger, Camus, Sartre and others. But these references are controlled from Harper’s own perspective, the result of his meditations on his own and other reports of interior experience. Suppose that a school restricts student expression critical of homosexual conduct yet allows or actively supports student expression that promotes acceptance and tolerance of gays and lesbians. Can such a policy be justified if the anti-gay speech disrupts the educational environment of the school while the pro-gay speech does not? Or does the differential treatment of anti-gay and pro-gay speech constitute unconstitutional viewpoint discrimination because it distorts the marketplace of ideas within the school? Can viewpoint discrimination ever be justified on (...) the ground that anti-gay speech invades the rights of others under Tinker v. Des Moines Independent Community School District, 393 U.S. 503 (1969)? These were among the questions debated by Judges Reinhardt and Kozinski in the Ninth Circuit's now-vacated panel opinion in Harper v. Poway Unified School District, 445 F.3d 1166 (9th Cir. 2006), but their significance to the law of student speech is quite general. Courts are increasingly becoming concerned with the question of whether Tinker allows viewpoint-based restrictions of student speech, but so far jurists have not reached agreement on this question or even on the simpler question of what counts as viewpoint discrimination. This article attempts to clarify the emerging debate about the permissibility of viewpoint discrimination under Tinker and proposes modifications to the Tinker framework that would enable courts to deal more fruitfully with charges that school officials have imposed viewpoint-based restrictions on student speech. I argue that we should think of viewpoint discrimination as purposeful restriction of expression on the basis of governmental disagreement with the message. Tinker must be understood to bar purposeful viewpoint discrimination, but the conclusion that a school speech restriction constitutes purposeful viewpoint discrimination will come at the end rather than at the beginning of constitutional analysis. A school will never announce that it has restricted student speech on the basis of disagreement with the message; instead, it will claim that it has regulated speech to prevent harm. And this is something that schools (and the state more generally) may sometimes do - at least with sufficient justification. Tinker obviously contemplates the regulation of speech where necessary to prevent two specific sorts of harms - disruption to the school's mission and violations of the rights of other students - and so must require courts to distinguish between school speech restrictions based on impermissible ideological purposes and those based on the permissible purposes of preventing disruptions or violations of student rights. Tinker's substantial disruption test, I contend, should primarily be understood as a mechanism for helping courts to smoke out these impermissible purposes. (shrink)
